These terms are an agreement between you and LIU WEI("TurnMyPhoto", "we"). By creating an account or using the service you accept them.
1. Who may use the service
You must be at least 18 years old and able to enter into a contract. You are responsible for the activity on your account and for keeping your login secure.
2. Photos you upload
You may upload only photos that you own or that you have explicit permission to use. Before a generation starts you attest that you are the person in the photos or that you have that person's permission. You must not upload a photo of a minor, a photo you do not have the right to use, or a photo that depicts someone else without their consent.
You keep ownership of your photos. You grant us the limited licence we need to store the photos, run the selected effect and deliver the result. We do not use your photos to train models.
3. What you may not do
Do not use the service to create sexual content, content involving minors, content that impersonates a real person, content that harasses or defrauds, or content that breaks the law. Do not attempt to bypass the credit system, the template catalogue or the safety controls.
4. Generated results
Results are produced by artificial intelligence and may contain errors or artefacts. You are responsible for how you use and publish a result. When you post a result on another platform, label it as AI-generated where that platform requires it.
5. Credits, purchases and refunds
Credit packs are one-time purchases sold through Waffo Pancake, our merchant of record. The price, the number of credits and the statement that the charge is one-time appear next to the checkout button before you pay. We do not currently sell auto-renewing subscriptions, so there is no renewal charge to cancel.
If we introduce a subscription, we will show its price, billing interval, renewal date and cancellation method next to the checkout button before you pay, and we will not renew it without the consent the law requires. If a generation fails, its credits are returned to your account automatically. Money refunds are not automatic; they are handled manually through Waffo Pancake. See the Refund Policy.
6. Removal of content
We may remove a result, archive a template or suspend an account when a report, a legal request or a payment-provider requirement calls for it. Anyone can submit a report through our report page.
7. Availability and liability
The service is provided as available. To the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to the amount you paid in the three months before the claim. Nothing here limits rights you have under mandatory law.
8. Changes and governing law
We may update these terms; the date above shows the current version. These terms are governed by the laws of the People's Republic of China, and disputes are handled by the competent people's court at the operator's domicile, without affecting mandatory consumer protections in your country.
9. Copyright complaints (DMCA)
We respect copyright and respond to notices under the Digital Millennium Copyright Act. Send a copyright notice to [email protected]. If a formal DMCA notice is required, we will provide the designated agent's contact details on request.
A notice must include: a physical or electronic signature; the copyrighted work you say is infringed; the material you say is infringing and enough information for us to find it (for example the effect slug or the report id); your name, address, telephone number and email; a statement that you have a good-faith belief the use is not authorised; a statement, under penalty of perjury, that the information is accurate and that you are the owner or are authorised to act for the owner. We may remove or disable access to the material and notify the person who uploaded it. That person may send a counter-notice, and we may restore the material as the statute requires. We may close the accounts of repeat infringers.
You can also use our report page for a faster first response. A report is not a substitute for a formal DMCA notice when you need one.
